The first-degree murder trial of 60-year-old Danny Paul Whitsel, charged in connection with a fatal January shooting in Gassville, has been postponed. The Baxter County Circuit Court approved a motion filed by Whitsel’s attorney to have him evaluated for mental competency.

Originally scheduled to begin Monday, the trial was delayed after defense attorney Justin Downum informed the court on October 12 of new information prompting the request for a mental evaluation. Circuit Judge Andrew Bailey ordered the evaluation on October 14, automatically suspending all trial proceedings until the court can review the results. In Arkansas, the competency evaluation process can take several months.

If Whitsel is deemed fit to stand trial, the court will schedule new dates. If found unfit, he will be placed in the custody of the Department of Human Services to address restoring his fitness for trial purposes.

Whitsel faces charges stemming from a January 20 altercation on Mountain Loop in Gassville that ended with the shooting death of 32-year-old Ian Lapio. According to the probable cause affidavit, the incident began with a confrontation between Lapio and Whitsel’s wife, 42-year-old Crystal Marie Whitsel. Crystal Whitsel reportedly told her husband that Lapio, a visitor in the neighborhood, had attacked her during an argument. Witnesses, however, disputed that claim, stating she had tripped during the altercation without being pushed.

Investigators allege Danny Whitsel confronted Lapio based on his wife's account but then escalated the situation by striking Lapio in the face with a pistol and shooting him multiple times, even after Lapio had fallen to the ground. Witness testimony and forensic evidence reportedly contradicted Whitsel's claim that he acted in self-defense. Six shell casings were recovered at the scene.

Lapio, described by authorities as lawfully present in the neighborhood, died from his injuries after being transported to Baxter Health.

Crystal Whitsel previously pleaded guilty to her role in the events and received a six-year prison sentence in June, with four years suspended and two to serve. She is currently incarcerated at the McPherson Unit in Newport. During her trial, Lapio’s widow expressed frustration with the plea agreement, claiming Crystal Whitsel’s actions had precipitated the fatal shooting.

Danny Paul Whitsel remains held at the Baxter County Detention Center on a $250,000 bond. Gassville police, with assistance from the Arkansas State Police, conducted the investigation into the shooting.
