A Batesville man was sentenced to three years of probation after pleading guilty to multiple counts of aggravated assault stemming from an encounter with a family at an apartment complex.

Court records show that 22-year-old Xavier Dupree Garcia entered a negotiated guilty plea on Tuesday to four counts of aggravated assault, which are Class D felonies. Sixteenth Judicial Circuit Court Judge Tim Weaver sentenced Garcia to 36 months of probation with a credit for 16 days already served in jail. He must also pay all court costs and fines, according to the sentencing order.

The charges stem from an incident on the morning of Oct. 11, 2025, at College View Apartments on Lawson Drive in Batesville. According to the probable cause affidavit, Batesville police responded to a report of a domestic disturbance around 7:14 a.m. after a couple claimed that Garcia pointed a gun at them while they held their children.

Corporal Stephen Schlotzhauer reported arriving at the scene and encountering Garcia in the hallway of the apartment complex. According to Schlotzhauer’s report, Garcia was "yelling and brandishing a firearm in his left hand." The officer, accompanied by Officer Jeff Tate, commanded Garcia to drop the weapon, which Garcia complied with before being detained.

The couple told police they had been arguing outside their apartment when Garcia began threatening them with a gun. The woman said her partner had gone to the lobby to calm down and, upon his return, was confronted by Garcia, who pointed a firearm at him and their child while yelling racial slurs. Garcia reportedly told the family, "We don’t play around here."

The affidavit also states that surveillance footage from the building corroborated parts of the victims' account. The video showed the man walking toward the hallway where Garcia was standing. Garcia can then be seen drawing a firearm and pointing it as the man retreated. The footage also shows the woman exiting their apartment with a child before joining her partner, during which Garcia continued to aim the gun at them from the hallway. The video contained no audio.

As officers detained Garcia, he reportedly said, "Man, he ran down on me," and added that he was "not trying to deal with these people."

Garcia’s plea agreement and sentencing close the case, which drew attention for the alarming nature of the confrontation involving young children. He avoided further jail time, but his probation terms require adherence to court orders and payment of fines.
