A Salem man is in custody after allegedly throwing a can of beans at his daughter and engaging in a violent confrontation with police officers. Dustin Niswonger, 41, is being held at the Fulton County Jail on charges that include assaulting a law enforcement officer and domestic battery.
According to a probable cause affidavit from the Salem Police Department, officers responded to a domestic disturbance at Niswonger's residence, where his daughter reported that he had hit her with a door and thrown a can of beans at her. Police observed visible injuries on the girl, including red marks on her knees and arm.
While one officer interviewed Niswonger outside the home, another officer remained inside to speak with the daughter and additional witnesses. During the outdoor interview, Niswonger reportedly threw a cigarette at the officer’s face. When officers attempted to arrest him, Niswonger fled toward a nearby truck. An officer tackled him, but Niswonger began physically fighting with both law enforcement officials.
Police used a baton on Niswonger’s legs to subdue him and eventually took him into custody. One officer sustained injuries to their knees and hand during the struggle.
Niswonger faces multiple charges, including felony second-degree assault on a law enforcement officer, as well as misdemeanor charges of resisting arrest, domestic battery in the third degree, fleeing on foot, and disorderly conduct. His bond has been set at $10,000.
